This notice explains how we process personal data when you visit www.dayoneultra.com and apply for a starting place at the day one Backyard Ultra.

1. Controller

Email: support@day-1.com

2. Hosting and server log files

The website and its backend are hosted by ALL-INKL.COM – Neue Medien Münnich, Hauptstraße 68, 02742 Friedersdorf, Germany. They are built and maintained by Die Agentur Lux, Benjamin Hösel, Franz Dullnig Gasse 7, 9020 Klagenfurt, Austria. When you visit the website, your browser transmits technical data (IP address, date and time, page requested, referrer, browser and operating system). We use this data only to deliver the website and keep it secure. Legal basis: Art. 6(1)(f) GDPR (our legitimate interest in a secure and reliable website). Server log files are deactivated, so this data is not stored. Both providers process data on our behalf under a data processing agreement (Art. 28 GDPR).

3. Cookies, analytics and advertising

Strictly necessary cookies and local storage (e.g. saving your cookie choice and your form input) are used on the basis of Section 25(2) TDDDG and Art. 6(1)(f) GDPR.

All other tools are only activated after you consent in our cookie banner (Section 25(1) TDDDG, Art. 6(1)(a) GDPR). You can withdraw your consent at any time via "Cookie settings" in the footer.

Advertising

These providers may transfer data to the USA and other third countries. Google and Meta are certified under the EU-US Data Privacy Framework (adequacy decision, Art. 45 GDPR). In addition, and for TikTok, the European Commission's Standard Contractual Clauses apply (Art. 46(2)(c) GDPR).

4. Applying for a starting place

Data: full name and email address (mandatory); your best races and your story (optional); date and time of your application and your confirmation of the checkbox. Without name and email address we cannot consider your application. Applications are stored in our own website backend on the servers of ALL-INKL.COM (section 2).

Purpose and legal basis: We use your data to review your application, allocate starting places, inform you of the result and enable selected athletes to register. Legal basis: Art. 6(1)(b) GDPR in conjunction with our entry terms. We also check for duplicate or automated entries (Art. 6(1)(f) GDPR, our legitimate interest in a fair allocation).

Selection: Part of the starting places are awarded by a jury of DayOne Performance GmbH based on stories and race history. The remaining places are drawn at random from all other eligible entries. Decisions are made by people; there is no automated decision-making under Art. 22 GDPR.

Wildcard: If you apply for a wildcard by posting a video with #dayoneultra on Instagram or TikTok, we view your public post and profile, contact you via the platform and, as set out in the entry terms, may repost your video (Art. 6(1)(b) GDPR).

Health information: You do not need to tell us anything about your health. If you choose to (e.g. in your story), we use it only for the jury's assessment, based on your explicit consent (Art. 9(2)(a) GDPR). You can withdraw this consent at any time; we will then delete that information.

5. Emails from day one

With the checkbox you agree that DayOne Performance GmbH may contact you by email about your application, the event, athlete updates and day one offers (Art. 6(1)(a) GDPR, Section 7(2) No. 2 UWG). In addition, we may inform you about our own similar products and events (Art. 6(1)(f) GDPR, Section 7(3) UWG). Only DayOne Performance GmbH sends these emails; we do not share your data with partners for advertising. There is no double opt-in for applications.

To send emails we use the email service provider Klaviyo Inc., 225 Franklin St, Floor 10, Boston, MA 02110, USA, under a data processing agreement (Art. 28 GDPR). Data may be processed in the USA; the transfer is based on the European Commission's Standard Contractual Clauses (Art. 46(2)(c) GDPR). Our emails contain tracking pixels that show whether an email was opened and which links were clicked, so we can improve our emails.

You can withdraw your consent and object to promotional emails and email tracking at any time, free of charge apart from basic transmission costs, via the unsubscribe link in every email or by email to support@day-1.com. This does not affect your application.

6. Recipients

Besides the service providers named above, we pass the name and email address of athletes who receive a starting place to the local event organiser in Spain, so that registration and race operations can be carried out. We do not sell your data or share it with third parties for advertising.

7. Retention

8. Your rights

You have the right to access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20), and to withdraw any consent at any time with effect for the future (Art. 7(3)). Contact: support@day-1.com.

You also have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU member state of your residence or workplace.

9. Right to object (Art. 21 GDPR)

Where we process your data on the basis of Art. 6(1)(f) GDPR, you can object at any time on grounds relating to your particular situation. We will then stop processing unless there are compelling legitimate grounds or the processing serves legal claims.

You can object to the use of your data for direct marketing at any time; we will then no longer use it for that purpose.
